The firm represented the proposed restrained party, a father who had a previous felony domestic violence conviction and had not seen his children in over three years. Despite this, Morales Law, P.C. was able to successfully dismantle the opposing party’s claims through sharp, strategic cross-examination.
The Court ultimately dismissed the DVRO and granted the client overnight visitation with his child. In its Statement of Decision, the Court highlighted:
“The cross examination was critical, and it impeached the underlying contentions she made on direct examination and in her declarations.”
This case marks a rare and remarkable result—one of the first instances where a court denied a DVRO despite a prior felony domestic violence conviction.
